Interview Question :: Are all these actions taken at work by the owner illegal


Okay, i work for a pizza company called hungry howies and im only 15. I think he is practicing illegal procedures and i need your help cause i dont know who to contact about this. He likes to clock out employees and have them still work, like when we close at 9 and im closing down the store, he preclocks us out at 9:20 and i wont be done till 9:40. I already know he broke many labor laws for minor so im not gonna ask about them but this one really bugs me out. We have this soda machine at our work and we're not allowed to get drinks but everyone still does. He caught me one day and lowered my wage by 50 cents. It bugged out everyone that worked there cause they said it was illegal to do such since i stilled kept the same position. Then i recently found out that my wage was lowered 50 cents more and he never told me about this and i think for sure thats illegal. I want to take legal action on him cause i hate him cause hes been lieing since day one but dont know who to contact. HELP :(

you must be paid for every minute that you work

your employer can raise or lower your rate at any time

as long as he pays you at least the minimum wage.

if you file a complaint the state will investigate and if this has happened you will receive your back pay and the employer may be penalized. you can not be terminated for filing a complaint and if you are then there are other penalties that will be applied to this business. being 15 does not mean you can be cheated or taken advantage of, be sure you are following all the appropriate laws and policies of your employer until this is resolved. do not do anything that would justify your employer terminating your employment, do your job to the best of your ability and let the state do theirs. no matter what happens report your claim so you will know if your employer is doing something wrong or not the only way to find out is to contact Texas Workforce Commission.

He must pay you for all hours worked. As far as rate of pay as long as he is above the minimum wage he can pay you any rate he chooses. Unless you have a contract that states differently. I believe that he is required by law to post certain information with regard to federal and local labor laws and on these postings there will be a hot line phone number that you can call to report suspected abuse. You could look in your local phone directory for the state labor board.

The clock-out thing may be illegal, but nothing else you mentioned is. If you don;t like it, get a different job.

CALL because he is ripping you and your co-workers off! Don't let him get away with this! Here is the number for the Texas department of labor Fraud division. 1-800-252-3642. what he is doing is illegal and BAD. You should call and do it soon. Good luck.

Labor relations board; and you'll probably end up losing the job...not that it would be a bad thing.

Based solely on what you have said:



1) It is Illegal to make you work after requiring you to sign or punch out.



2) It is illegal to lower your wage without notice.



3) Everything else you mentioned is not illegal. Yes, he can reduce your pay for stealing product (soda).



You are 15 years old. Frankly, I'd just keep on working there knowing what it's like and move on to another job as soon as you can find one.



I don't think you want to get your parents (you're a minor) involved in pursuing justice against the "jerk" you work for. Look at it this way: why should your take your time and spend your money to teach this "jerk" a lesson. Who cares about this "jerk." Someday, somebody, will teach this "jerk" a thing or two---hopefully after you have moved on to bigger and better things.



Look at it this way: you have now experienced working for a "jerk" who thinks he's smarter than his youthful staff. Well, he's not, and he falls far short of that mark.



In one way, this experience is positive: you are learning how it is out there working for a living. I know of no better motivational technique than this for showing a teenager the advantages of seeking a good education.



There are a lot of crooks out there, that's why there are a lot of criminal lawyers and prosecutors: that's life.

If he clocks you out at 9:20 then it's illegal for you to work past 9:20, and you're entitled to pay for all the time past clocking out that you've worked.



Lowering your wage for stealing from the soda machine is legal. Lowering your wage without telling you is illegal - you're entitled to be paid at the 'agreed on' rate. If he lowers your wage it applies only to work done AFTER he tells you.



The Texas labor board does not, I'm afraid, pursue unpaid/underpaid wage cases for employees. (They're one of the few States where that's the case).



Since you're 15, you'll have to get your parents to file a small claims lawsuit against him for the underpayments.



You can make a report of any violations to the labor board. They will undertake punitive actions - which hurts him but doesn't help you.

Your boss is a thief. Quit and find work with an honest employer. He can lower your wage if he wants, if it's not lower than minimum wage, but clocking you out while you're still working is a lowdown, stinking, filthy act of cowardly stealing that is beneath the morals of a dog.



DO NOT ASSOCIATE WITH THIEVES -- you already said you know you're doing illegal work for the bastard -- well what do you expect? When you deal with crooks, you deal with crooks! Good god, boy... you think that he's hiring you to steal from someone else so he'll deal honestly with YOU?



Learn a lesson from this. Do not make deals with thieves.



Quit. Find a better job.

Contact the labor board. You may need a parent to help you with this since you are still a minor. They are the ones that regulate the wages and time. You will need to file a claim with them. And if needed, you could always seek the assistance of a labor law attorney.
